A szervezők szerint az egyhetes konferencia legikeresebb paneljének előadói között szerepelt többek között Janet Nosworthy, a Libanoni Különleges Törvényszék bírája, illetve az USA Légierő nyugalmazott ezredese, Linda Strite Murnane katonai bíró. A panelt Vanessa Ruiz, Washington D.C. feljebbviteli bírája vezette.
A panel témája a Nemzetközi Büntetőbíróság Bemba-ügyben szexuális bűncselekményekért való parancsnoki felelősségben való bűnösség ügyében hozott felmentő ítélete körül forgott. A fő kérdés az volt, hogy a nemzetközi jog hogyan bünteti a szexuális erőszakot háború idején, mi a szabályok be nem tartásának oka, mik a szexuális erőszak elkövetésének főbb indítékai és előfordulási gyakorisága, hogyan értékelhető a Bemba-ítélet, és milyen jogi keretek között történne felelősségre vonás az USA-ban egy hasonló cselekmény esetén.
Dr. Varga Réka előadásában elmondta, hogy a nemzetközi jogi szabályozás egyértelműen tiltja a szexuális erőszakot háború idején. A szabályok be nem tartásának főbb okai között kiemelte a parancsnokok felelősségre vonásának hiányát, illetve reményt keltőnek nevezte a nemzetközi közvélemény, az ENSZ, a humanitárius szervezetek és az államok ébredező érdeklődését a téma iránt. Hangsúlyozta, hogy ugyan a statisztikák szerint háború esetén elkerülhetetlennek tűnik a szexuális erőszak, az ilyen cselekmény soha, semmilyen körülmények között nem igazolható.

Dr. Réka Varga, associate professor of our Faculty lectured on conflict related sexual violence at the 2019 Annual Conference of the American Bar Association Section of International Law on 12 April in Washington DC. The panel included lectures by Hon. Janet Nosworthy, Judge of the Special Tribunal for Lebanon and Col. (Ret.) Linda Strite Murnane, former military judge of the US Air Force. The panel was hosted by Hon. Vanessa Ruiz, senior judge of the Washington District of Columbia Court of Appeals.
The topic of the panel centred around the acquittal of Jean-Pierre Bemba in front of the International Criminal Court for sexual violence based on command responsibility. The main questions of the panel included how international law prohibits sexual violence in armed conflicts, what are the reasons for lack of compliance with the rules, what are the motives and prevalence of sexual violence, how can we assess the Bemba-judgment and how would the American legal system deal with a similar case in the US.
Dr. Varga highlighted that international law clearly prohibits sexual violence in armed conflicts. One of the reasons for non-compliance with the rules can be lead back to lack of responsibility of commanders. She regarded the change of attitude of the international community, the UN, humanitarian organizations and states toward this topic as very promising, and underlined that although statistic show that sexual violence is prevalent in armed conflicts, it can never, under any circumstances be justified and should therefore not be an inevitable feature of armed conflicts.
