Vorpositive Ordnungselemente / Pre-Positive Elements in Roman Law

A jogrend pre-pozitív elemei olyan elveket és normákat jelentenek, amelyek a jogalkotást megelőzően, illetve attól függetlenül léteznek, és amelyek mérceként szolgálnak a tételes (pozitív) jog igazságos voltának megítéléséhez. Míg a pozitív jog érvényessége a jogalkotói aktusból ered, a pre-pozitív elemek normatív erejüket tartalmi helytállóságukból, illetve igazságosságukból merítik. Ezen elemek rendszerint előzetesen adott normatív rendhez kapcsolódnak, amely alapját az emberi természet, az értelem, illetve a hagyományok képezhetik.
A workshop célja a római jog egyes pre-pozitív elemeinek vizsgálata, valamint azok megjelenésének elemzése konkrét történeti összefüggésekben. A rendezvény kiemelt figyelmet fordít az esetalapú megközelítésekre és a forrásközpontú elemzésre, különösen jogászi szövegek, jogesetek és levelezési források vizsgálatán keresztül. Az elméleti reflexió és a források szoros elemzésének összekapcsolásával a workshop a római jogi gondolkodás és gyakorlat mögött meghúzódó normatív struktúrák árnyaltabb megértéséhez kíván hozzájárulni.

The notion of pre-positive elements of legal order refers to principles and norms understood to exist prior to, or independently of, state legislation and to function as standards against which the justice of enacted (positive) law may be assessed. While positive law derives its validity from legislative authority, pre-positive elements claim normative force by virtue of their substantive correctness or justice. Such elements are commonly associated with a pre-existing order grounded in human nature, reason, or traditions.

(Roman law offers a particularly illuminating context for examining these foundations of legal normativity. Roman jurists frequently relied on evaluative concepts and argumentative structures that transcended the mere application of enacted rules and instead reflected deeper assumptions concerning equity, rational order, and the nature of justice within legal reasoning.)

This workshop seeks to investigate selected pre-positive elements mainly within Roman law and to analyse their manifestation in actual historical contexts. Particular attention will be devoted to case-based discussions and source-oriented approaches, including juristic writings, legal disputes, and epistolary evidence. By linking theoretical reflection with close engagement with sources, the workshop aims to contribute to a more nuanced understanding of the normative structures underlying Roman legal thought and practice.
